By proceeding with this transaction you agree to be bound by the following terms and conditions:
TERMS & CONDITIONS
1. Interpretation
1.1 In this Agreement ‘OAE’ means Online Auto Electrics.
1.2 Customer or you means the customer placing this purchase order with OAE.
1.3 Goods means the goods ordered by you from OAE.
1.4 This Contract shall be governed and construed in accordance with the laws in force in the State of Queensland and the parties submit to the non-exclusive jurisdiction of the Courts of Queensland.
2. Agreement Between Parties
2.1 Upon ordering goods from OAE you hereby agree to be bound by these Terms & Conditions and a binding Contract is created between you and OAE upon such order being placed.
2.2 These terms and conditions contain the whole Agreement between the parties unless OAE and the customer agree in writing that any other correspondence, discussions or documents shall form part of this agreement and the parties agree that all warranties implied under statute or the common law will not operate upon this Agreement.
3. Obligations of OAE
3.1 OAE must: -
(i) pending payment and subject to Clause 4 of this Agreement, deliver the goods ordered by the customer to the customer’s delivery address within a reasonable time;
(ii) ensure the goods are free from defects and that the goods perform their intended function.
3.2 A failure by OAE to perform those obligations mentioned in Clause 3.1 of this Contract does not give the customer a right or cause of action at law against OAE or a right to terminate this Contract.
4. Your Obligations
4.1 It is a condition of this Agreement that payment be made by you in respect of goods ordered from OAE and proper payment details provided by you before proceeding with this transaction.
4.2 You acknowledge that OAE reserves the right to refuse any order where it is apparent to OAE that payment details provided by you are incorrect, improper or the subject of fraud.
4.3 You acknowledge payment is a condition precedent to shipment and OAE reserves the right to refuse any order where it is apparent that payment of goods ordered by you cannot or is unable be processed.
4.4 Notwithstanding Clauses 4.1, 4.2 & 4.3 OAE reserves the right to render tax invoice/s in respect of goods ordered by you in circumstances it so chooses and you hereby agree to pay any tax invoice rendered by OAE by the due date for payment specified on the tax invoice.
4.5 If any tax invoice is not paid by the due date for payment OAE shall be entitled to charge interest on such amount as is outstanding from time to time at the rate of 1.5% per month.
4.6 Notwithstanding Clauses 4.4 & 4.5 the customer acknowledges it will remain liable to OAE for the total price of the goods whether or not the goods have been shipped, delivered or a tax invoice rendered in respect of the goods so ordered.
5. Delivery
5.1 Upon receipt of payment by OAE risk in the goods passes to the customer unconditionally, whether or not the goods are specific, ascertained, unascertained or future goods at the time risk is deemed to pass.
5.2 In addition to but without limiting Clause 3 of this Contract the customer hereby agrees OAE will not be liable in any way, whether in any action in contract, negligence or other tortious action, arising out or as a result of damaged goods or delayed delivery reasonably related to any matter connected with shipment of the goods by OAE to the customer.
5.3 The customer agrees to pay OAE for all shipping and freight costs associated with delivery of the goods to the customer.
6. Variation
6.1 You hereby acknowledge upon receipt of any order placed by you, OAE reserves the right to alter the character of the goods ordered prior to delivery as might reasonably be necessary taking into account the availability of the goods or any other matter beyond OAE’s control.
7. Shipping and delivery Policy
7.1 We deliver products Australia wide using overnight air bags through companies such as TOLL PRIORITY.
7.2 We also have suppliers with warehouses in every capital city in Australia that will use local couriers to get the product to you as quickly as possible.
7.3 Orders are dispatched as soon as payment is cleared and will in most instances be overnight delivery, depending on where you are located in Australia.
7.4 Exact shipping costs are calculated in the shopping cart and will be added to the order total before checkout.
7.5 Online Auto Electrics ships goods World wide, for international orders (outside Australia) please email sales@onlineautoelectrics.com.au prior to any purchases on the website for delivery costs.
8. Pricing policy
8.1 All of our prices are in Australian dollars (AUD) and include GST ( goods and services tax) as of 01 July 2010.
8.2 Product prices are regularly updated when price changes are received from our suppliers.
8.3 If you find a cheaper advertised price somewhere else, email us with the details of the supplier together with prices of the product required and we will endeavour to provide you with a more competitive price.
9. Customer service policy
9.1 Online Auto Electrics is committed to providing exceptional customer service and quality products.
9.2 We endeavour to make sure that all products listed on our website we currently have in stock or can source from one of our many suppliers.
9.3 In the event that an ordered item is not available or we are unable to fulfill your order we will notify you as soon as we have knowledge of this, to arrange an agreeable alternative item, a backorder or a full refund.
10. Refund/Return Policy
10.1 Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong decision.
10.2 You can choose between exchange or store credit coupon where goods are faulty have been wrongly described, are different to the product purchased on the website or don’t perform as advertised.
10.3
Online Auto Electrics will not be responsible for, or refund any freight charges to or from a customer for any return parts regardless of reason for return.
11. Warranty
11.1 6 month warranty on commercial vehicles.
11.2 12 month warranty on passenger vehicles.
11.3 The warranted part must be returned to us for inspection prior to the exchange or store credit coupon given. Postage for the part back to us will not be refunded .Online Auto Electrics will not be responsible for consequential damage, vehicle down time or alternate transport cost's.
12. Privacy policy
12.1 Online Auto Electrics is dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured.
12.2 We do not pass on, sell or swap any of your personal details with anyone. We use this information to identify your orders, provide you with newsletters and to personalize your shopping experience with us.
13. Security Policy
13.1 When purchasing from Online Auto Electrics your financial details are passed through a secure server using the latest 128 – bit SSL (secure sockets layer) encryption technology.
